These Terms of Service apply when you access the Hard Unit website, create an account or purchase products from us.

Your consumer rights come first. Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Acceptance of these terms

By using our website or placing an order, you agree to these terms and the policies referenced in them. If you do not agree, you should not use the website or place an order.

If there is an inconsistency between these terms and a product-specific condition or promotion, the more specific condition applies to the extent of the inconsistency.

2. Eligibility and accounts

You must be at least 18 years old to create an account or place an order. If you are under 18, you may only use the website with the involvement and permission of a parent or legal guardian.

You must provide accurate, current and complete information when creating an account or placing an order. You are responsible for keeping your account credentials secure and for activity undertaken through your account.

Please contact us promptly if you believe your account has been accessed without permission.

3. Product information

We take reasonable care to ensure product descriptions, specifications, images, prices and availability are accurate. However, minor differences may occur between a product and how it appears on a screen, including differences in colour, finish, packaging or labelling.

Measurements, capacities, inflation times, performance figures and other specifications may be approximate or based on particular testing conditions. Actual results can vary according to the product, vehicle, tyre, load, environment and operating conditions.

Where a product page provides model-specific specifications, ratings, warnings or instructions, those details form part of the product information and should be reviewed before purchase and use.

We may update product information or discontinue products without notice. Changes will not reduce any rights applying to an order that we have already accepted.

4. Product use and safety

You must use products only for their intended purpose and in accordance with the supplied instructions, warnings, load ratings, operating limits and applicable laws.

Before use, inspect the product for damage, wear or missing components. Do not use a product if it appears damaged, defective or unsuitable for the intended application.

Products involving vehicle recovery, towing, lifting, tyre inflation, electrical connections or other potentially hazardous activities must be used with appropriate care and equipment. Where installation or use requires technical knowledge, obtain assistance from a suitably qualified person.

Never exceed a product’s stated working load limit, pressure rating, electrical rating or operating limit.

5. Orders and acceptance

Placing an order is an offer to purchase the selected products. Receiving an automated order confirmation does not necessarily mean that we have accepted the order. An order is accepted when we confirm dispatch or otherwise expressly confirm acceptance.

We may decline or cancel an order before acceptance where reasonably necessary, including because:

a product is unavailable or incorrectly listed;
there is an obvious pricing or product-information error;
payment cannot be authorised or verified;
we reasonably suspect fraud, unauthorised activity or misuse;
we cannot deliver to the supplied address; or
the order would breach an applicable law or restriction.

If we decline or cancel an order after payment has been taken, we will refund the affected amount using the original payment method wherever reasonably possible.

Please review your products, quantities and delivery details carefully before submitting an order. If you need to cancel or change an order, contact us as soon as possible. We cannot guarantee that changes will be possible after processing or dispatch has commenced.

6. Prices and payment

Unless clearly stated otherwise, prices displayed on the Australian Hard Unit store are in Australian dollars and include GST.

Shipping charges and any applicable additional freight costs are displayed or communicated separately. Additional charges may apply to heavy or bulky products, dangerous goods, or deliveries to regional and remote locations.

If an additional freight charge was not shown at checkout, we will contact you before dispatch. You may agree to the additional charge or cancel the affected order for a refund.

Payment must be made using a payment method available at checkout. Payment methods may be provided by third-party payment providers and can be subject to their own eligibility requirements and terms.

Promotional prices, discount codes and special offers may be subject to separate conditions, expiry dates, exclusions and stock availability.

7. Dispatch and delivery

We dispatch orders to the delivery address supplied during checkout.

In-stock orders are dispatched within 24 hours on business days. Orders placed on weekends or public holidays are processed on the next business day. Where a different dispatch timeframe is shown on a product page, that product-specific timeframe applies.

Dispatch time is different from delivery time. Delivery estimates depend on the destination, carrier, product and external conditions. Estimated delivery dates are guides and are not guaranteed.

We are responsible for fulfilling your order in accordance with applicable law. We are not responsible for delays caused solely by events outside our reasonable control, but this does not affect any rights you may have under the Australian Consumer Law.

Orders may be delivered in more than one parcel. You are responsible for ensuring that the delivery address entered at checkout is complete and accurate. Contact us immediately if an address needs to be changed, although changes may not be possible after dispatch.

Risk in the products passes to you when they are delivered to the nominated delivery address or collected by a person authorised by you. Ownership passes after we have received full payment.

8. Returns, refunds and consumer guarantees

Products sold in Australia come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy if a product fails to meet an applicable consumer guarantee.

Our 30-day change-of-mind return policy is an additional benefit and does not limit your Australian Consumer Law rights.

Change-of-mind returns must satisfy the conditions set out in our Returns and Refunds Policy. Different rules apply to faulty, damaged, unsafe or incorrectly described products.

Warranty information is available on our Warranty page. Any manufacturer’s warranty or express warranty is additional to your rights under the Australian Consumer Law.

9. Website availability and accuracy

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access. We may temporarily suspend or restrict website access for maintenance, security, operational or technical reasons.

If we identify an error in product information, availability or pricing, we may correct it. If an error materially affects an order that has not yet been accepted, we will contact you and provide the option to proceed on the corrected basis or receive a refund.

Nothing in this section permits us to avoid obligations or remedies that apply under Australian law.

10. Acceptable website use

You must not use the website:

for an unlawful, fraudulent or malicious purpose;
to infringe another person’s intellectual property, privacy or other rights;
to transmit malware, harmful code or misleading information;
to impersonate another person or misrepresent your identity;
to interfere with the security, availability or proper operation of the website;
to collect personal information without authority;
to send spam or unauthorised promotions; or
through automated means in a way that places an unreasonable load on the website, circumvents access controls or interferes with other users.

We may suspend or restrict access where we reasonably believe these requirements have been breached.

11. Intellectual property

The website and its content—including the Hard Unit name, logos, designs, product copy, graphics, photographs, videos and layout—are owned by or licensed to Hard Unit and are protected by applicable intellectual property laws.

You may access and use the website for personal shopping and other lawful purposes. You must not reproduce, modify, distribute, commercially exploit or republish website content without our prior written permission, except where permitted by law.

Third-party names, logos and trademarks remain the property of their respective owners.

12. Reviews, photographs and other submissions

If you voluntarily submit a product review, photograph, suggestion or other content, you confirm that:

you created the content or have permission to submit it;
the content is accurate and reflects your genuine experience;
the content does not infringe another person’s rights; and
the content is not unlawful, defamatory, abusive, misleading or malicious.

You grant us a non-exclusive, worldwide, royalty-free licence to reproduce, display, edit for formatting and use the submitted content to operate and promote Hard Unit and its products. You retain ownership of your content.

We may moderate or remove submitted content where reasonably necessary, including where it breaches these terms or applicable law. Any incentive offered for a review is for an honest review and does not require a positive review.

13. Third-party links and services

The website may include links to or functionality provided by third parties, including payment providers, delivery carriers and social media services.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control. This does not exclude responsibility that cannot lawfully be excluded.

14. Shopify

Our online store is hosted and supported by Shopify. Shopify provides the ecommerce platform that enables us to offer products for sale.

Sales made through this store are between you and R. King Enterprises Pty Ltd trading as Hard Unit. Shopify is not the seller of the Hard Unit products you purchase.

15. Privacy

We collect, use and disclose personal information as described in our Privacy Policy.

Because the store is hosted by Shopify, Shopify also processes information needed to provide and improve its services. Shopify’s handling of personal information is subject to its applicable privacy documentation.

16. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, we are not liable for loss that was not reasonably foreseeable or that results from:

use of a product contrary to its instructions, warnings or stated limits;
unauthorised modification, misuse or improper installation;
information or circumstances outside our reasonable control; or
your breach of these terms or applicable law.

To the extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when the relevant order was made.

17. Suspension and termination

You may stop using the website at any time.

We may suspend or terminate an account or restrict access where we reasonably believe there has been fraud, unlawful conduct, a security risk or a material breach of these terms.

Termination does not affect rights and obligations that arose before termination, including payment obligations, accepted orders, intellectual property rights and provisions that are intended to continue.

18. Changes to these terms

We may update these terms from time to time by publishing a revised version on this page. The updated terms apply from the stated effective date.

Material changes will not retrospectively alter the terms applying to an order already accepted unless required by law or agreed with you.

19. Governing law and disputes

These terms are governed by the laws of South Australia and the Commonwealth of Australia.

You and Hard Unit submit to the courts of South Australia and any courts entitled to hear appeals from them. This does not prevent you from exercising any mandatory rights available under the laws applying to you.

If you have a concern, please contact us first so we can try to resolve it promptly. Nothing in these terms prevents either party from exercising legal rights or contacting an appropriate regulator, tribunal or dispute-resolution body.

20. General provisions

If part of these terms is found to be invalid or unenforceable, that part will be read down or severed to the minimum extent necessary. The remaining provisions will continue to apply.

A failure or delay in enforcing a right does not waive that right.

These terms and the policies incorporated by reference form the agreement between you and Hard Unit concerning your use of the website and purchases from the store. They do not exclude representations or rights that cannot lawfully be excluded.
